Terms of Service

Introduction

These Terms of Service (“Terms”) govern your access to and use of TisFile, a software-as-a-service platform operated by Tisfile S.R.L., a company registered in Romania (“TisFile”, “we”, “us”, or “our”).

By creating an account, accessing the dashboard, embedding the TisFile viewer, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Definitions

Subscriber

Any individual or business that creates an account and subscribes to a paid plan.

End User

Any person interacting with the TisFile viewer embedded on a Subscriber's website.

Service

The TisFile platform, dashboard, APIs, viewer widget, and related services.

Content

Any files, data, models, logos, or information uploaded to the Service.

Service Description

TisFile provides tools that allow Subscribers to:

  • Upload 3D models (STL files)
  • Configure logo engraving and customization options
  • Embed an interactive 3D viewer on their own websites
  • Receive quote requests from End Users
  • Download customized STL files
  • Use TisFile Studio to generate AI-driven product imagery and 3D models from reference images and prompts

TisFile does not manufacture physical products and does not interact directly with End Users except through embedded technology. AI generation features rely on third-party providers listed in our Privacy Policy.

Eligibility

  • You must be at least 18 years old (or the age of majority in your jurisdiction)
  • You must have the legal authority to enter into these Terms
  • Business registration is not required

Accounts & Subscriptions

5.1 Account Registration

Subscribers must provide accurate and complete information and keep it up to date.

5.2 Authentication

Authentication is handled via OAuth providers or magic link emails. TisFile does not store passwords.

5.3 Subscription Plans & Pricing

Subscription plans, pricing, and limits are displayed on the website.

Price Changes

We reserve the right to modify pricing at any time. Existing subscribers will be notified at least 30 days in advance via email before any price increase takes effect. New pricing applies at the start of your next billing cycle after the notice period.

5.4 Billing

  • Subscription billing is monthly and recurring
  • Payments are processed by Stripe
  • You may cancel anytime via the Stripe customer portal
  • No refunds are provided on subscription fees unless required by law

5.5 Studio Credits

TisFile Studio is metered using prepaid credits. Subscribers purchase credit packs (priced in EUR) and credits are consumed when AI operations are run (image generation, 3D model generation, video generation, etc.). The credit cost of each operation is shown in the dashboard before the operation is triggered.

  • Credits are non-transferable between accounts
  • Credits do not expire while your account is active
  • Once consumed by a successful AI operation, credits are non-refundable
  • If an AI operation fails before generating output, credits are automatically refunded to your balance
  • Auto-top-up (optional) charges your saved card when your balance falls below your configured threshold; you may disable it at any time
  • Daily, per-IP, and burst spend caps are enforced to protect against abuse and runaway costs

Subscribers are responsible for keeping their saved payment methods valid and for monitoring credit usage. We are not liable for failures to generate caused by insufficient credit balance or cap enforcement.

Platform issues? If a generation failed because of a problem on our side, or you believe credits were debited incorrectly, contact us at titus@tisfile.com and we will review the case and refund credits where appropriate.

5.6 Studio Early Access

TisFile Studio is currently offered in “Early Access”. During Early Access, the only charge is for credit consumption — there is no separate Studio subscription fee.

  • Merchants who join during Early Access keep credit-only pricing for the lifetime of their account, with no Studio subscription fee added later
  • After Early Access ends, new merchants will pay a monthly Studio subscription on top of credit consumption
  • Credit pack prices and per-operation credit costs may change during Early Access with at least 7 days’ notice via email; changes apply only to purchases and operations made after the notice period
  • Early Access does not guarantee uptime, feature stability, or backwards compatibility — APIs and behaviour may change as the product evolves

5.7 AI-Generated Output Disclaimer

TisFile Studio uses third-party AI models to generate images and 3D models. AI output is probabilistic and may contain errors, artifacts, or content that does not match your prompt or reference image.

  • We do not guarantee the accuracy, suitability, manufacturability, or fitness for purpose of any AI-generated output
  • Subscribers are responsible for reviewing AI output before using it commercially or showing it to End Users
  • Subscribers must ensure they have rights to all reference images, logos, and prompts they submit, and that the resulting output does not infringe on third-party rights
  • AI providers may impose their own usage policies; we will pass along material restrictions when we become aware of them

Subscriber Responsibilities

Subscribers agree to:

  • Own or have legal rights to all uploaded STL files and content
  • Ensure End Users have rights to uploaded SVG logos
  • Maintain their own privacy policy for End Users
  • Keep API keys secure
  • Use the Service in compliance with all applicable laws

Subscribers must not:

  • Resell or sublicense the Service
  • Reverse engineer or attempt to extract source code
  • Share account access
  • Use the Service for illegal, abusive, or infringing activities

End Users

End Users:

  • Do not create TisFile accounts
  • Interact only through embedded viewers
  • Submit data on behalf of the Subscriber

TisFile has no direct relationship with End Users.

Intellectual Property

8.1 TisFile IP

TisFile retains all rights to:

  • The platform and infrastructure
  • Viewer widget and APIs
  • Rendering and engraving algorithms
  • Trademarks, branding, and logos

8.2 Subscriber Content

Subscribers retain ownership of all uploaded content.

8.3 License to TisFile

Subscribers grant TisFile a non-exclusive, worldwide, limited license to store, process, render, and display content solely for providing the Service.

This license terminates upon content or account deletion.

Data Processing

  • Subscribers are data controllers for End User data
  • TisFile acts as a data processor
  • Processing is governed by the Privacy Policy and GDPR

Service Availability

10.1 General

  • The Service is provided "as is"
  • No uptime guarantee
  • Maintenance or outages may occur
  • Features and APIs may change or be discontinued with reasonable notice

10.2 Project Shutdown & Credit Refunds

We reserve the right to discontinue TisFile Studio or the entire TisFile platform. The notice period depends on whether Studio is still in Early Access at the time of the shutdown announcement:

  • While Studio is in Early Access: at least 1 month written notice (via email) before the Service is shut down
  • After Studio has graduated from Early Access: at least 2 months written notice (via email) before the Service is shut down

If we discontinue Studio (or the platform), Subscribers may request a refund of their remaining unused credit balance, calculated at the EUR value of credits purchased and not yet consumed. Refund requests must be sent to titus@tisfile.com within 90 days of the shutdown announcement. Signup-bonus credits and other promotional credits granted at no cost are not refundable.

Limitation of Liability

To the maximum extent permitted by law, TisFile is not liable for:

  • Subscriber–End User disputes
  • Manufacturing errors or print accuracy
  • Business losses
  • Third-party service failures
  • Data provided by Subscribers or End Users
Maximum liability is limited to the total amount paid by the Subscriber in the 12 months preceding the claim.

Termination

12.1 By Subscriber

You may cancel at any time. Access remains until the end of the billing period.

12.2 By TisFile

We may suspend or terminate accounts for:

  • Violations of these Terms
  • Non-payment
  • Illegal activity
  • With 30 days' notice, for any reason

Upon termination:

  • Access is revoked
  • API keys are disabled
  • Viewers stop functioning
  • Data is deleted per retention policy

Governing Law & Jurisdiction

These Terms are governed by the laws of Romania.

Any disputes shall be resolved by the competent courts of Romania.

Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email. Continued use constitutes acceptance.
